Far from being an “externality”, land tenure can be a real threat with huge financial risks. Of late, investments around real estate, infrastructure, mining, power and agri-business are facing conflicts, delays and often getting stalled. One of the major reasons behind this increased stalling of investments, which reached an all-time high of INR 13 trillion in June, 2019 has been delay in land acquisition. Additionally, the financial sector, especially Banks, owe a substantial burden of their NPAs to land-based investments. Land remains a finite resource and its availability, valuation and tenure are often inappropriately interpreted and speculated, leading to contestations fuelling high investment risks. On the other hand, the agriculture sector has also witnessed contestations due to land tenure complications around common land, leasing practices and women land rights.
 
Integration of risk management, therefore, into corporate governance and finance is the need of the hour in India. Emerging examples in the form of global instruments provide directions and experiences that can be very useful to make prudent decisions that do not lock-in investments into irreversible losses and costly legal procedures.  This executive education module aims to build the capacity of corporate leaders and executives on new ways of managing land tenure risks and strategies for sustainable and responsible investment.
